Hi - two questions with the checkout process in eMember where users are signing up for recurring subscription payments:
1. I can't get the "only logged in members can checkout" to work (I have the "Only logged in members can check out" box checked in eStore); and
2. Is there a way to have users accept the TOS for subscription payments?

The "only logged in members can checkout" option is for shopping cart checkout only. "Buy Now" and "Subscription" buttons are fast payments and do not go through the normal checkout process of eStore.
So how do you you achieve what you are after? Use eMember section protection feature to protect the "Subscription" button so only logged in members can interact with the button.
You can put something like the following just above or below the button to cover the TOS side of things:
"You agree to the terms and condtions (link to your TOS) by making a purchase"
